An emergency motion for a stay pending appeal was requested on Tuesday by MGA Entertainment to continue making and selling Bratz dolls until the appellate court decides its case through the U.S. Court of Appeals for the Ninth Circuit.

"[T]he imposition of the Injunctive Orders is a gross miscarriage of justice," according to the motion. "For conduct that the jury found caused relatively minor harm to Mattel, the district court not only barred MGA from selling any Bratz female fashion dolls ... [it] bestowed upon Mattel all of MGA's Bratz trademarks and their associated value and goodwill. The district court's disproportionate orders rest on multiple stark errors of law, any one of which would require reversal."

Last week, U.S. District Judge Stephen Larson ordered the end of the temporary receivership of MGA Entertainment, as well as its right to manufacture and sell the doll line. Larson said a permanent receiver would not be appointed and the company's management would be returned to founder and chief executive officer Isaac Larian.
