The trial over the rights to the Martha Stewart brand between Macy’s and J.C. Penney began Wednesday in New York and is scheduled to take three weeks.

The dispute began in 2011 when JCP and Martha Steward Living Omnimedia announced plans for a series of mini-shops in department stores across the U.S., according to a report on CNN Money.

Macy’s claims that the JCP shops will violate its own agreement with MSLO that gives the retailer an exclusive license for Martha Stewart-branded products in several categories including bedding and dinnerware.

A spokesperson from MSLO told CNN Money that the brand is not Macy’s “in-house designer” and asserted that the company can design products for anyone it chooses.
