Macy's contends that Martha Stewart Living granted the retailer the exclusive rights to manufacture and sell products in categories such as cookwear, kitchen utensils and bed and bath in 2006, according to the case filed Monday in the New York state Supreme Court. Macy's contends that the agreement had been extended through 2018.
In December 2011, Martha Stewart Living inked a deal with JCPenney to open in-store retail environments featuring Martha Stewart products and product specific trained sales associates. The in-store environments are scheduled to open in 2013.
Macy's is seeking a preliminary injunction to stop Martha Stewart from violating the contract, according to news reports.
