The most intriguing story this week concerns LVMH’s victory over eBay in the French courts – not because it pins some responsibility on eBay for sales of counterfeit goods, but because eBay argued that LVMH is using the case to enshrine in (French) law the use of selective distribution agreements. And the case is by no means over. Ebay is to appeal against the court decisions, so this is an important case to watch for all licensors who do territorial, exclusive product, or sector deals.
